Warranty Policy

LAUDA-Brinkmann sells this product under warranty that is set forth below. The warranty is extended only to the buyer purchasing the product directly from LAUDA-Brinkmann, or as a new product from an authorized dealer or distributor of LAUDA-Brinkmann that has a corresponding invoice number.

LAUDA-Brinkmann’s warranty has a period of twenty-four (24) months from the date of delivery.

LAUDA-Brinkmann parts are warranted against manufacture defect for a full year.

If warranty coverage is established, all costs for transportation and/or travel charges are the responsibility of the purchaser/buyer

LAUDA-Brinkmann’s products are warranted against functional defects in design, materials and workmanship, provided the product is properly operated under conditions of normal use, and that repairs and replacement are made in accordance herewith.

LAUDA-Brinkmann’s warranty shall not apply to normal wear and tear, or if the product has been altered, disassembled or repaired other than by LAUDA-Brinkmann, or if the product has been subject to abuse, misuse, negligence, shipping damage, or accident.

LAUDA-Brinkmann’s sole and exclusive obligation, and the purchaser’s sole and exclusive remedy under the warranty plan, are at LAUDA-Brinkmann’s option, limited to repairing, replacing or revising, labeling, and manual content on, product (1) which contains a defect covered by warranty; (2) which are returned to LAUDA-Brinkmann promptly after discovery of the defect; and (3) which are found to be defective upon examination by LAUDA-Brinkmann. Should a Product fail to meet such standard within such period, Customer shall submit its claim and the defective Product to LAUDA-Brinkmann for repair, stating the defects and the circumstances under which the defect occurred. LAUDA-Brinkmann will examine the Product, and upon establishing the validity of the Customer’s claim, at its sole discretion repair or replace the Product, which shall fully satisfy and/or discharge any and all warranty claims.

LAUDA-Brinkmann’s warranty extends to every part of the product except consumables, which are included but not limited to fuses, batteries, tubing or glass breakage. All parts in direct contact with corrosive chemicals may not be covered by warranty and are considered consumable due to normal wear.

Determination for making the repair onsite at the Customer facility versus in-house will be made by LAUDA-Brinkmann at the time of the warranty repair scheduling. Customer will be responsible for shipping and insurance expenses from the equipment location to the LAUDA-Brinkmann service center. Product damage incurred during the shipment to LAUDA-Brinkmann is the responsibility of the Customer.

LAUDA-Brinkmann does not cover the following under warranty, which is included but not limited to:

Warranties shall not apply where the product has been subject to accident, alterations, misuse, abuse, acts of nature, or failure on the part of the Customer to ensure proper operation and/or storage.

Warranties do not cover defects resulting from improper or inadequate maintenance, installation, repair or calibration performed by the Customer or a third-party not authorized by LAUDA-Brinkmann service.

Warranty only remains valid on the condition that service is provided by an authorized LAUDA-Brinkmann service company.

If a product is purchased in the United States and moved outside the contiguous United States, the warranty is voided unless agreement is made before original purchase.

Warranty on any used or demonstration products are delivered with a ninety (90) day warranty only.

LAUDA-Brinkmann does not cover any warranty for the calibration of any instrument.

Any Extended Warranty purchased and paid for by the Customer will be valid for one (1) year from the expiration date of the standard warranty purchase. Extended Warranties are only valid with the purchase of a new LAUDA unit and must be purchased before the expiration date of the original standard warranty. Consecutive warranties can be purchased, year after year, prior to any warranty expiring.

CUSTOMER ACKNOWLEDGES THAT LAUDA-BRINKMANN’S WARRANTY IS NOT TRANSFERRABLE OR REFUNDABLE, THAT THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE WARRANTY GRANTED HEREIN. IN NO EVENT SHALL LAUDA-BRINKMANN BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, AND DAMAGES ARISING OUT OF THE TRANSPORTATION, UNLOADING, HANDLING, AND USE OF ANY PRODUCTS, ALL OF WHICH ARE WAIVED BY CUSTOMER.
